Default Pilot's Bill of Rights/Youtube

Thought this deserved a new thread rather than drifting the thread on the video of the Sheikh doing a short take off over water.

In that thread the discussion turned to what the FAA might do when videos are posted with questionable flying, and I guess the answer is if there is visible proof that the FAR's have been violated then they may well take action. They can however also, if they feel that flying has been suspect, take action.

The FAA itself has in the past taken questionable action against pilots, a well known, example, Bob Hoover's certificate revocation. At an Oke City airshow Bob did the show routine he is famous for, but two observers in the crowd—inspectors that the Federal Aviation Administration sends to all air shows—were not impressed and thought his flying flawed.

This was not that he had broken any regs, they just felt his flying had not been up to scratch?? They ordered him to get a physical. He did—and passed. The FAA wasn't satisfied, chose another set of doctors to examine him, and this time he was judged unfit to fly and the FAA grounded him. There have been other such cases,

Hoover eventually got back into the air after a long struggle, however it seems steps have now been taken to curb such over enthusiasm on the part of certain officials.

The Pilots Bill of Rights put forward by Sen. James Inhofe (R - Okla.) has just been signed into law, bringing with it a hopefully new era of transparency. The FAA must expand legal protections for pilots by providing access to investigative reports and ATC recordings, as well as handing over evidence being used as the basis of enforcement 30 days before any action is taken.

In addition to creating new legal protections for pilots, the bill also requires the FAA to improve and simplify its notam reporting system, and review the medical certification process and forms, with the goal of demonstrating how the agency can reduce the instances of misinterpretation that many say have led to allegations of intentional medical falsification against pilots in the past.

So if you do get a tap on the shoulder, you will get the evidence, and 30 days to get your story straight on just what was happening on that Youtube clip you thought was pretty cool.


Oh, and yes, this is a little tongue in cheek.

On August 3, 2012, the Pilot’s Bill of Rights (PBR or “the Act”) became effective, requiring the FAA provide certain written notifications to individuals who are the subject of an investigation relating to a certificate suspension, revocation, or modification action or the approval or denial of a certificate. The law also requires that the FAA make accessible to such individuals air traffic data as described in paragraph 5 that would facilitate the individual’s ability to productively participate in a proceeding relating to an investigation described in the Act. Except as provided in paragraph 13, the PBR requires written notification of the following as applicable:

Jeff like most legislation, the blizzard of words, forms and weight of paper alone is almost enough to snow most people into submission from the start, freedom or not!

I would agree with that , but at least now a person has a chance! In the past the inspector might come to talk about something else and then start asking questions related to the violation before you knew what was happening. At least now they have to upfront about it.
